Capitol punishment banned in some cases?

While capitol punishment is a still a hotly debated issue, a bill could pass that would ban using it on certain people. Jenny Hoff has more from the State Capitol.

Mentally retarded criminals might not have to face execution as a possible punishment.

Representative Ralph Monaco-D of Raytown says its not fair that capitol punishment could be used on individuals not in complete control of their actions.

Contents: Monaco says the Supreme Court is even looking at this issue, as it may violate the 8th ammendment-no cruel and unusual punishment.
